These Terms and Conditions of Sale and Use apply to purchases from LUMENGY LLC, lumengy.com, and related LUMENGY sales channels. By using this website, submitting an order, or purchasing any product from LUMENGY, you agree to these terms, our Privacy Policy, and any related policy pages referenced here. Please read them carefully.

2. Pictures, Renderings, and Technical Specifications

LUMENGY attempts to provide accurate product images, drawings, renderings, technical specifications, dimensions, color temperatures, wattage information, lumen information, installation descriptions, and related details. However, manufacturers and suppliers may make changes to product appearance, packaging, materials, measurements, components, or performance.

Minor differences in appearance, finish, brightness, color temperature, dimensions, material texture, packaging, and performance may occur. LUMENGY is not responsible for minor variations that do not materially change the intended use of the product.

In some cases, LUMENGY may show pictures or renderings of several colors, sizes, or variations of a product even when a specific color, size, or variation is not shown in every image. Some images are used to demonstrate installation style, lighting effect, application, or design concept.

The color, brightness, contrast, and tone shown on a monitor, phone, tablet, printed page, or digital display can vary. LUMENGY recommends purchasing and testing one unit before placing a large order to confirm the product size, brightness, color temperature, and lighting effect are suitable for your project.

3. Prices, Taxes, and Payment

Prices shown on lumengy.com are listed in United States dollars unless otherwise stated. Prices generally do not include shipping, sales tax, customs duties, import fees, installation costs, transformers, accessories, or other charges unless specifically stated on the product page or checkout page.

LUMENGY strives to avoid pricing errors. If a product is mistakenly listed at an incorrect price, LUMENGY may refuse, correct, or cancel the order, whether or not the order has been confirmed and whether or not a payment method has been charged.

If your payment method has already been charged and your order is cancelled because of a pricing error or other issue, LUMENGY will issue a refund or credit to the original payment method for the amount charged.

LUMENGY makes no representation or warranty that all content, pricing, specifications, descriptions, or availability information is error-free, complete, current, reliable, or correct at all times.

4. Availability and Submission of Orders

LUMENGY offers products that it believes are available at the time the product is displayed or ordered. Inventory can change quickly, especially for popular lights and bulk orders.

If LUMENGY discovers that it cannot fulfill all or part of an order for any reason, including stock shortage, system inventory error, duplicate orders, supplier delay, discontinued product, carrier restriction, suspected fraud, payment issue, or pricing error, LUMENGY may cancel all or part of the order and notify you as soon as reasonably possible.

You will not be charged for products that are not shipped. If payment was already collected for unavailable items, LUMENGY will issue a refund for the unavailable portion or offer the option to wait until new stock arrives when appropriate.

To avoid errors or duplication, LUMENGY requires orders in writing. Telephone or verbal orders are not binding unless confirmed in writing by LUMENGY. Purchase orders should be emailed to LUMENGY for written confirmation.

5. Fulfillment and Shipping

LUMENGY uses multiple fulfillment centers, including Amazon for storage and fulfillment, and may also ship directly from its own warehouse or other fulfillment locations. This allows LUMENGY to provide faster and more reliable service to customers in different locations.

LUMENGY primarily uses Amazon Shipping, UPS, USPS, FedEx, and other trusted carriers. These services are selected because they generally provide reliable transit, tracking information, delivery confirmation, and, when available, delivery photos. Because customers often purchase 10, 50, 100, or more lights at a time, orders may ship from multiple fulfillment centers and may arrive in multiple boxes on different days. Separate packages may have separate tracking numbers.

Please keep the packing slip, shipping slip, receipt, and any paperwork included inside each box. These documents help verify the products received, shipment origin, quantities, and any claim for missing items.

Once the products have been shipped and are in the possession of the shipping carrier, the risk of loss transfers to the buyer to the extent permitted by law. LUMENGY has no control over the carrier handling, transit, route, delivery timing, delivery location, or package security after the package is handed to the carrier.

Important: Orders may arrive in multiple shipments and on different days. Please keep every shipping slip and packing slip from each box until the full order is confirmed received.

6. Missing Shipments, Stolen Packages, Damaged Packages, and Missing Items

Missing Shipments

If the shipping carrier loses a package during transit, LUMENGY will assist you in filing a claim with the carrier when possible. However, once the package has been transferred to the shipping carrier, LUMENGY cannot be held liable for loss caused by the carrier.

Stolen Packages

LUMENGY is not responsible for packages stolen from a porch, front door, driveway, mailbox area, mailroom, lobby, gate, business entrance, construction site, job site, or any other delivery location after the carrier marks the package as delivered. Customers should use a secure delivery location and monitor tracking updates.

Damaged Packages

If a package arrives damaged, refuse delivery if possible. If delivery has already been accepted, take clear photographs of the damaged package, label, box, packaging materials, and product condition immediately. Notify LUMENGY promptly so we can assist with the carrier claim process when appropriate.

Missing Items

If any items are missing from your shipment, notify LUMENGY within 24 hours by email at info@lumengy.com. Include the order number, photos of all boxes, photos of all packing slips, photos of the products received, and any shipping labels. Without the receipt or packing slip from inside the box, LUMENGY may not be able to accept or support a missing item claim.

How to File a Shipping Claim

Document the issue. Take clear photos of the package, labels, damage, missing items, evidence of tampering, packing materials, and all paperwork inside the box.
Contact the shipping carrier. Provide tracking information, photos, and a description of the issue.
Notify LUMENGY within 24 hours by emailing info@lumengy.com. LUMENGY may assist with the claim process, but its role is limited to reasonable support and facilitation.

LUMENGY works to pack orders securely and comply with carrier requirements. However, once the package is in the carrier network, LUMENGY does not control the carrier and cannot guarantee carrier performance.

7. Stock Availability, Inventory Errors, and Amazon Fulfillment

LUMENGY products are in high demand. In rare cases, the website, Amazon inventory system, or connected inventory software may show an item as available when multiple customers order the same product at the same time.

LUMENGY reserves the right to cancel an order if the system accepted a duplicate order, oversold the product, displayed an incorrect inventory quantity, or if stock becomes unavailable before fulfillment.

If an item is out of stock after you place your order, LUMENGY will notify you as soon as possible. You may be offered a refund or the option to wait until new stock arrives.

LUMENGY uses Amazon to store some inventory and provide fulfillment. Amazon is generally reliable and offers fast delivery. However, pricing and promotions on Amazon may differ from pricing on lumengy.com, and LUMENGY is not required to match Amazon prices or vice versa.

8. Shipping Time

Shipping time depends on how close the delivery address is to one of LUMENGY fulfillment centers, stock availability, carrier availability, order size, product quantity, weather, holidays, job site location, and other factors outside LUMENGY direct control.

Orders are generally processed within 1-2 business days when inventory is available. LUMENGY always tries to ship priority when possible, but delivery times are estimates and are not guaranteed. Large orders, especially orders of more than 50 lights, may require multiple shipments. If you are ordering more than 50 lights and need them by a specific date, please contact LUMENGY before placing the order so we can review stock, fulfillment location, shipping options, and delivery timing. For orders of 100 or more units, please contact LUMENGY before placing the order for better delivery options, freight options, pricing, timing, and coordination.

9. Installation of Products

Installation must be performed by a qualified and licensed electrician or other qualified professional where required by law, code, or project conditions.

Any installation performed by someone other than a qualified and licensed professional is performed by the buyer at the buyer own risk and liability.

Installation must comply with all local, city, county, state, and federal laws, rules, building codes, electrical codes, safety codes, and industry standards. Products should be installed only for their intended use and according to the product page, product instructions, installation guidance, and applicable codes.

To allow future replacement or service, buyers and installers should make sure wires remain accessible when possible and should consider using conduit or other appropriate methods for wire protection and future access. Costs related to removing, accessing, repairing, replacing, or reinstalling lights, wires, pavers, hardscape, concrete, decks, walls, steps, or any surrounding materials are not the responsibility of LUMENGY.

SELLER SHALL NOT BE RESPONSIBLE FOR ANY LIABILITY, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH ARISING FROM THE USE, MISUSE, OR INSTALLATION OF SELLER PRODUCTS.

10. Returns

Items must be returned within 30 days of purchase unless a different written policy applies to the specific order.

Returned items must be new, unused, uninstalled, unmodified, undamaged, and in original packaging. Items that have been opened, installed, modified, used, damaged, cut, scratched, altered, or returned without proper packaging may not be eligible for refund.

The order number should be included on or inside the return package. Customers are responsible for return shipping costs unless otherwise agreed in writing by LUMENGY.

After LUMENGY receives and inspects the returned items, eligible refunds are generally processed within 3-5 business days. Bank or card processing times may vary.

No returns are available for wholesale orders unless LUMENGY agrees otherwise in writing.

11. Warranties

ALL PRODUCTS ARE SOLD AS IS EXCEPT FOR THE EXPRESS LIMITED WARRANTY STATED HERE. LUMENGY DISCLAIMS ALL WARRANTIES OF ANY KIND RELATING TO THE PRODUCTS OR USE OF THE PRODUCTS, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

The limited warranty guarantees that eligible products will be free from defects in materials and workmanship when installed, operated, and maintained according to applicable codes, regulations, supplied instructions, product specifications, and normal use conditions for the time periods listed below.

For warranty requests, please contact LUMENGY through the warranty or contact form. Before submitting a warranty claim, test the specific light by connecting it directly to a compatible transformer. In many cases, lighting problems are caused by connection issues, loose wires, incompatible transformers, incorrect power, or installation problems rather than a failed light.

What the Warranty Does Not Cover

Misuse, mishandling, misapplication, neglect, vandalism, accident, improper installation, improper maintenance, improper packaging of returned products, unauthorized modification, use of unauthorized parts or attachments, or repair by anyone other than LUMENGY.
Power surges, power spikes, incorrect voltage, use outside the acceptable voltage range, incompatible transformers, non-approved electronic transformers, non-approved dimmers, incorrect AC or DC power, or other electrical problems.
Acts of God and extreme weather events, including lightning, floods, hail, tornado, fire, earthquake, hurricanes, and similar events.
Products used in conditions beyond the intended product rating or outside normal use conditions.
Labor or costs to remove, access, repair, replace, reinstall, or restore any defective, repaired, or replaced product, including pavers, concrete, walls, steps, decks, landscaping, wiring, conduit, job site work, or other materials.

Water, Moisture, Pools, and Harsh Environments

Warranty does not cover water damage to products caused by submersion, continuous water exposure, direct water impact, irrigation, drainage, fountains, pools, jacuzzis, ponds, lakes, oceans, rivers, saltwater, minerals, high humidity, persistent moisture, or other aggressive environments unless the product is specifically designed and sold for that use.

Many LUMENGY products are IP67-rated, meaning they are dust-tight and water-resistant for brief immersion up to 1 meter under standard test conditions. IP67 protection is intended for ordinary outdoor exposure and occasional water contact. It is not intended for continuous submersion, direct water jets, ongoing irrigation spray, drainage flows, standing water, underwater use, or installation in areas with constant water exposure.

Products should be installed at least 10 feet away from water sources, including fountains, pools, jacuzzis, ponds, or similar water features, unless LUMENGY provides written approval or the product is specifically rated for that application.

Installations near oceans, lakes, rivers, or other natural water bodies may be exposed to salt, minerals, moisture, humidity, and other environmental stressors that can accelerate corrosion, wear, discoloration, and product aging. Such exposure is considered beyond standard wear and tear and is not covered by warranty.

Transformers and Finishes

Transformers must be installed according to their instructions and applicable codes. Evidence of improper transformer mounting, wiring, voltage, protection, or use can void warranty coverage. Transformer housings on oceanfront or coastal properties should be protected from direct salt spray and aggressive environmental exposure.

It is normal for natural brass and copper finishes to patina, oxidize, and change color. Other finishes, including powder coatings and painted surfaces, may discolor, fade, blister, chip, scratch, or otherwise change when exposed to sunlight, irrigation, reclaimed water, seawater, acid rain, fertilizers, chemicals, physical impact, and other aggressive agents. These finish changes, patina, discoloration, and residue build-ups are not covered by warranty.

If a product is covered by warranty, LUMENGY may, at its sole option, repair the product, replace the product, provide a comparable product, provide a credit, or refund the purchase price of the product. The foregoing warranties are exclusive and in lieu of all other warranties.

12. Limitation of Liability

The limited warranty provides the buyer sole and exclusive remedy relating to LUMENGY products.

LUMENGY shall not be liable for claims, demands, or actions against the buyer by third parties; any loss or claim, including personal injury or death, arising from use or installation of products; or any loss or claim arising from the buyer implementation of advice, recommendations, or instructions related to products.

IN ALL CIRCUMSTANCES, THE MAXIMUM LIABILITY OF LUMENGY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD.

If a LUMENGY product is mistakenly listed with incorrect information, price, image, description, specification, availability, quantity, or promotion, LUMENGY reserves the right to refuse or cancel any orders placed for that product.

You agree to indemnify, defend, and hold harmless LUMENGY LLC, lumengy.com, its officers, directors, employees, agents, licensors, suppliers, affiliates, service providers, and partners from and against all claims, losses, expenses, damages, liabilities, costs, and attorney fees resulting from any violation of these Terms, misuse of the website, misuse of products, unauthorized use of intellectual property, negligent or wrongful conduct, or activity related to your account or your use of the website.

The entire content included on this website, including text, graphics, photographs, product images, product designs, renderings, videos, icons, layouts, software, and code, is copyrighted as a collective work under United States and international copyright laws and is the property of LUMENGY LLC, lumengy.com, its licensors, or its content providers.

Permission is granted to electronically copy and print portions of this website solely for personal, non-commercial use, placing an order with LUMENGY, or purchasing LUMENGY products. Any other use, including reproduction, distribution, display, transmission, republication, modification, scraping, download for competitive use, or commercial use, is strictly prohibited unless authorized by LUMENGY in writing.

You agree not to remove, alter, or delete proprietary notices, copyright notices, trademark notices, patent notices, or other ownership notices from materials downloaded, printed, saved, or viewed from the website.

Many products were designed to solve real installation problems that LUMENGY identified through years of experience in outdoor lighting, pavers, hardscape, decks, and contractor work.

Any unauthorized copying, importing, manufacturing, offering for sale, selling, listing, marketing, advertising, or distribution of products that infringe LUMENGY intellectual property may be pursued to the fullest extent permitted by law.

19. Severability

If any provision of these Terms is held illegal, invalid, unenforceable, or in conflict with any law by a court of competent jurisdiction, that provision shall be deemed severed or modified only to the extent necessary, and the validity and enforceability of the remaining provisions shall not be affected.

20. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California applicable to contracts made and to be enforced within California, without reference to conflict of law rules and without application of the United Nations Convention on Contracts for the International Sale of Goods.

Notwithstanding the foregoing, LUMENGY shall have the right to commence and prosecute any legal or equitable action in any court of competent jurisdiction, including outside the United States, when LUMENGY believes such action is necessary or desirable to protect its intellectual property, business rights, products, brand, or customers.

21. Waivers and Amendments

LUMENGY may amend, modify, or update these Terms at any time without prior notice. Updated terms may be posted on the website with a revised effective date. Continued use of the website or purchase of products after changes are posted constitutes acceptance of the revised Terms.

22. Sales Tax

If your shipping address is in California, LUMENGY is required to collect sales tax unless you will resell the product and provide a valid seller permit and completed resale certificate acceptable to LUMENGY.

If your shipping address is in a state where LUMENGY is required to collect sales tax, applicable sales tax may be collected at checkout. If tax is not collected, you may still be responsible for use tax or other taxes under applicable law.

For resale orders, LUMENGY may require a completed and signed resale certificate before processing the order. This may be required the first time you buy and periodically thereafter if requested by LUMENGY.

23. Duties, Customs, and International Fees

If your shipping address is outside the United States, you are responsible for all customs duties, import taxes, brokerage fees, tariffs, destination charges, local taxes, and any other fees charged by the destination country, carrier, broker, or government authority.

International shipping delays, customs holds, import restrictions, and rejected import shipments are outside LUMENGY control. The customer is responsible for confirming that the product can be imported and used in the destination country.

24. Entire Agreement

These Terms, together with the Privacy Policy, Return Policy, Warranty Policy, product pages, written order confirmations, and any other written policy expressly incorporated by reference, constitute the entire agreement between you and LUMENGY regarding use of the website and purchase of products.

These Terms supersede prior agreements, statements, discussions, representations, or understandings related to the website, products, or orders, unless a separate written agreement signed by LUMENGY expressly states otherwise.
